Indian Government Classifies Accounting and Tax Services as 'Financial Services' Under IFSCA Act
The Indian government has recognized bookkeeping, accounting, taxation, and financial crime compliance services as financial services under the IFSCA Act. This broadens the scope of services available in International Financial Services Centers (IFSCs), opening new opportunities for businesses and professionals.
In a significant move, the Indian government has designated bookkeeping, accounting, taxation, and financial crime compliance services as financial services under the International Financial Services Centres Authority (IFSCA) Act of 2019. This notification, issued on January 18, 2024, specifies that these services qualify as financial services when provided by units located in an International Financial Service Centre (IFSC) regulated by the IFSCA. The development aims to attract more international businesses to India's growing IFSCs, offering a broader range of financial services to non-resident clients.
The new classification includes services such as accounting, taxation, and financial crime compliance, which encompasses areas like Anti-Money Laundering (AML) norms, Countering the Financing of Terrorism (CFT) measures, and recommendations from the Financial Action Task Force (FATF). To qualify as financial services under the IFSCA Act, these services must be offered to non-residents whose businesses are not formed by the splitting up, reconstruction, or reorganization of existing Indian businesses. Moreover, the units offering these services must not engage in the transfer or receipt of existing contracts from their group entities in India.
This expansion of financial services under the IFSCA Act is expected to make India’s International Financial Services Centres more attractive to global businesses. By broadening the range of services available to international clients, India is positioning its IFSCs as key hubs for financial services in the global market. The inclusion of financial crime compliance services also signals the country's commitment to adhering to international financial standards, which could further enhance its appeal to foreign investors. As these services are now recognized under the IFSCA Act, companies in IFSCs can offer a more diverse array of solutions to clients, further boosting India’s presence in the global financial ecosystem.
This designation could have a significant impact on India’s financial sector, attracting both international firms and foreign clients to India’s IFSCs. The move aligns with the government’s vision to promote India as a global financial hub and provide an enhanced regulatory environment for international businesses. By enabling financial services such as accounting and tax services to be offered in IFSCs, India is positioning itself to play a greater role in the international financial services market. This could lead to an influx of international business, creating more opportunities for growth and collaboration between India and foreign financial institutions.
The classification of accounting and tax services as financial services under the IFSCA Act could significantly boost India’s International Financial Services Centres, attracting international business and enhancing the country's role in global finance.
